1) Acceptance of Terms

By registering for an account, creating or joining a pool, or otherwise using PoolHost.com (the “Service” or “Services”), you (“User”) agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.

2) Definitions

• Pool Admin: A user who creates and manages a pool on PoolHost.com.
• Pool Member: A user who joins a pool operated by a Pool Admin.

3) Use at Your Own Risk; No Warranty

Users participate in the Service at their own risk and will not hold PoolHost.com responsible for any problems that may arise due to membership or use. The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will operate continuously, be error-free, or be available at any particular time.

4) Scores, Standings, and Timeliness

Game scores and standings are updated on a best-effort basis. While we often update within an hour of game completion, live or immediate updates are not guaranteed. At worst, updates may take until the following day. Actual timing may vary due to data provider availability, system maintenance, or other factors outside our control.

5) No Gambling; No Prizes

PoolHost.com does not condone or support gambling and does not collect or distribute cash or prizes based on pool results. Using the Service to facilitate gambling between persons is strictly forbidden. Users are solely responsible for complying with all applicable laws and regulations in their jurisdiction.

6) Communications & Email Consent

By creating an account or using the Service, you consent to receive communications from PoolHost.com related to your account and operation of the Service. These include:

• Transactional & Required Emails (cannot be disabled): password resets, account verification, security alerts, critical service or policy notices, and responses to your support inquiries.
• Service Notifications You Can Control: newsletters and product updates; pick-entry reminders and alerts. You can manage these in your user profile by clicking the profile icon (upper right) → Edit Profile → the Communication tab. There you may turn off newsletters and disable pick-entry alerts.

You agree to maintain a valid email address in your profile and acknowledge that missed communications caused by spam filters, mailbox issues, or inaccurate contact information are your responsibility. Some discretionary emails may also include an unsubscribe link for your convenience.

7) Pool Admin ↔ Pool Member Communications

When you join a pool, you implicitly agree to receive communications from that pool’s Pool Admin (e.g., pool instructions, reminders, and updates). These communications may be sent through the Service and/or to your registered email address.

If you do not wish to receive communications from a specific Pool Admin, you must remove yourself from that pool. You can do this by navigating to My Pools in the menu and choosing to Resign from the pool. PoolHost.com does not control, endorse, or guarantee the content of Pool Admin communications, and is not responsible for any such messages. Please report abusive content through our Support channels.

8) User Conduct

• Do not use the Service to facilitate or promote illegal activity, including gambling.
• Do not harass, threaten, or abuse other users or Pool Admins.
• Do not post infringing, unlawful, or offensive content.
• Do not attempt to interfere with the security, availability, or proper functioning of the Service.

9) Message Boards & Moderation

PoolHost.com retains the right to remove any message or content at any time, for any reason, without notice. We may also restrict or terminate access to the Service for violations of these Terms or for any other reason at our discretion.

10) Account Suspension or Termination

PoolHost.com retains the right to remove any user from our system and to suspend or terminate accounts at any time, for any reason, without notice or liability.

11) Intellectual Property

The Service, including its content, features, and functionality, is owned by PoolHost.com and its licensors and is protected by intellectual property laws. Users retain rights to content they post where applicable, but grant PoolHost.com a non-exclusive license to host and display such content to operate the Service.

12) Limitation of Liability

To the fullest extent permitted by law, PoolHost.com, its owners, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party, including Pool Admins and other users; (c) unauthorized access, use, or alteration of your transmissions or content; or (d) reliance on scores, standings, or other information provided through the Service.

13) Indemnification

You agree to indemnify and hold harmless PoolHost.com and its owners, affiliates, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14) Changes to the Service and to These Terms

We may modify or discontinue the Service (in whole or in part) at any time. We may also update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms on the site and updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
